Project Report:
Niskanen Center’s Climate Policy and Litigation Initiatives
- Investigates the causes of economic imbalances.

Compelling government responses to climate risks and defending property rights from fossil-fuel infrastructure eminent-domain claims.

Investigate the causes of economic imbalances, particularly in relation to ecosystem services, climate change, energy security, and other environmental matters.

Climate-related litigation has a major impact on public policy and plays an important role in containing and reversing anti-climate regulatory and legislative action. Niskanen legal opposition signals that support for science and rational thinking and opposition to blatant political interference in the energy marketplace is a bipartisan matter that should not be viewed through a left-right ideological prism.

In addition, the explosion in U.S. shale gas and shale oil has caused an unprecedented building spree of oil and gas pipelines. As a result, pipeline companies across the country are acquiring land (or interests in land). Often these companies are using eminent domain to take property from the owners against their will. The Niskanen Center proposes an effort to coordinate environmental and property rights groups throughout the country in cases where landowners are (or could be) fighting eminent domain by pipeline companies.
